I've always been a happy guy. I
always smiled, because I knew I was
blessed by God. I always loved my

In 2002, Kevin Michael Thornton was convicted of a rape he didn't commit.

How do we know he didn't commit the crime?

  • The jury TOLD the judge there was reasonable doubt of his guilt. Legally, there was
    plenty of evidence to suggest he did not rape the victim, and under the law, the
    State is required to prove beyond a reasonable doubt (99.9%) that the defendant
    committed the crime in question. The state fell short of that requirement in the eyes
    of the jury. The jury stated in its letter "Many of us agreed that there was
    reasonable doubt to question whether he actually had sexual intercourse with
    Sara. However, we reached a guilty verdict due to the aiding and abetting clause
    because of the verdict we had reached on Lofton Rigby (Kevin's co-defendant)."
    This letter was unprecedented in a court of law, but still, the judge said that was not
    enough to get a new trial.
  • Kevin's attorney stood idly by while his client, who had just turned 18 and had never
    been in trouble before, was tried alongside a predicate felon with gang ties, who
    had already robbed and assaulted an unarmed man the same night as the rape.
  • Kevin's key witness, the only witness not charged, plead the Fifth Amendment. He
    had learned that he was about to be indicted as an accessory, because he provided
    a condom to the rapist and drove the party to a secluded area.
  • Kevin's only witness was his high school librarian who testified to his impeccable
    character. Not his mother, a Christian, hardworking, single mom with four children,
    nor Kevin's twin sister, who could testify to any tenet of his personality.
  • No seminal fluid was ever found in or on the victim, and the victim never positively
    stated that Kevin was her attacker. She had consumed mass quantities of alcohol
    and was vomiting blood and passing out when she was raped by Kevin's co-
    defendant. On the stand during Kevin's trial, she changed her version of events
    several times.
  • Kevin turned 18 just a few days before the rape took place in early September,
    2001. Days later, America was attacked on September 11, 2001. Kevin had worked
    for years to build up additional summer and other school credits so that he could
    graduate early and serve our country in the United States Army -- an assignment
    that almost guaranteed he would serve in a heavy infantry unit in Iraq. Instead, he
    was convicted of a horrible crime and sent to jail, and is forced to register as a sex
    offender for the rest of his life.

Kevin Thornton will be on probation through
September of 2009 unless a judge really considers his
case. So far, judges have bent the law to deny his
pleas, and have used poorly-researched and
outdated laws to keep him under the control of the
state and to continue to punish Kevin for a crime he
never committed.

We have also come to realise, through the assistance
of volunteer counsel, that even if all parties involved,
including the victim, came forward and admitted Kevin
never raped anyone, loopholes in the justice system
still would prevent a total exoneration for Kevin
Thornton.

JusticeforKevin.org has created a new petition, which
will be filed in court along with a request for a judge to
order an end to Kevin's probation sentence, and to
declare that the judgment set upon Kevin by the court
has been satisfied.

In the one year since Kevin's probation was modified
to extend through 2009, Kevin has started his own
business, has become engaged, has lived in the same
home (and plans to for at least another year) and has
been completely law-abiding and has followed all
probation requirements. He does not deserve to be
continually punished for a crime he never committed
to begin with.

We, the undersigned, support Kevin Michael
Thornton's plea for leniency and his petition for
satisfaction of judgment. We believe there is
reasonable doubt that he commited the crime for
which he was originally charged and convicted, and
we believe that his behavior since then has been
exemplary. We hereby ask the judge assigned in this
matter to give leniency to a man who was never truly
proven guilty beyond a reasonable doubt, and to
declare that Kevin Michael Thornton has fulfilled his
punishment and has paid his debt to society.
